1. Return of goods of proper quality under the Civil Code of the Republic of Lithuania, the Resolution of the Government of the Republic of Lithuania (22-07-2014) approving the Retail Trade Rules, and the Retail Trade Rules themselves
If the Consumer concludes a sales contract (the Contract) using only means of distance communication (a distance contract) and therefore cannot exercise the statutory right to inspect the goods and assess the nature of the services before concluding the contract, the Consumer has the right to withdraw from the sales contract by notifying the Seller in writing within 14 (fourteen) days from the day of delivery. If the Buyer purchased several items under one Contract, the Buyer may withdraw from the purchase of all items or only some of them. The 14-day period for submitting the written request starts from the day the goods are handed over to the Buyer or the Buyer’s authorised representative and is not extended or otherwise linked to the handover or return of the goods to the Seller or another person for reasons beyond the Seller’s control. Purchased goods of proper quality may be returned within 14 days if:
- the returned item is in its original, undamaged packaging;
- the item is unused and undamaged;
- the item has not lost its commercial appearance (labels intact, protective films, bags etc. not removed);
- the returned item is complete, with all documentation supplied by the manufacturer;
- the purchase document and warranty card (if issued) are provided with the returned item.
Goods of proper quality cannot be returned if they are:
- audio and video works and phonograms on any audio or video media, or computer software, if the packaging seal has been broken;
- newspapers, magazines or other periodicals;
- goods made to the Buyer’s individual order or clearly personalised, or goods which by their nature cannot be returned after delivery because they lose their commercial properties, deteriorate quickly or expire;
- other cases where withdrawal from the sales contract is not possible under the laws of the Republic of Lithuania.
Please deliver the returned item to the gigabyteshop.lt store. When returning goods of proper quality, the buyer is responsible for:
- packing the goods;
- delivering the goods to the gigabyteshop.lt store (except where the wrong item was received).
We may refuse to accept a returned item if changes were made to the appearance of the item or its packaging that were not necessary to inspect the item, including damaged labels, removed protective films and damage to transparent packaging that would not prevent the right to inspect the item.
If damage to the packaging means the item cannot later be sold at the same price without infringing another buyer’s right to purchase a new and unused item, such items may be returned only by mutual agreement (e.g. if you agree to compensate the loss in value).
When returning an item bought in the online shop, we will ask you to submit a written request in free form stating the order details: order number, date, item, price and delivery date. The request must include the bank account for the refund.
We undertake to refund the amount you paid within 14 business days, not counting the time needed for an authorised service centre to confirm that the item is in proper condition (i.e. no damage, faults or replaced parts are found, and the serial numbers of the purchased and returned item match, etc.).
If an additional order discount was applied at the time of purchase and you return only some of the items bought in one order, we may deduct the discount amount from the refund.
If the Consumer concludes a sales contract in the Seller’s store and can exercise the statutory right to inspect the goods and assess the nature of the services, a request to return a purchased item of proper quality for the reasons set out in Article 6.362 of the Civil Code may be granted only if the Seller agrees to accept the goods.
This provision applies to non-returnable goods listed in the Retail Trade Rules:
- machinery and mechanical appliances (Combined Nomenclature codes 8401–8487);
- electrical machinery and equipment, sound recorders and reproducers, television image and sound recorders and reproducers (Combined Nomenclature codes 8501–8548);
- optical, photographic, cinematographic, measuring, checking, medical or surgical instruments and apparatus (Combined Nomenclature codes 9001–9033);
- other goods listed in point 17 of the Retail Trade Rules.
2. Return of goods of improper quality and other cases, under the Civil Code of the Republic of Lithuania, the Resolution of the Government of the Republic of Lithuania (22-07-2014) approving the Retail Trade Rules, and the Retail Trade Rules themselves
Where the reason for return is the purchase of goods of improper quality, we undertake at our own expense to replace the faulty item with one of proper quality or to refund the price paid, once an authorised service centre confirms that the item is faulty due to a manufacturing defect, i.e. no damage caused by improper use by the buyer, faults or replaced parts are found, and the serial numbers of the purchased and returned item match, etc.
